The contract for the supply of heating oil is made between you, the customer and Top Oil.
These conditions apply to: all orders placed by the customer for heating oil done on this website or over the phone. By using this website, you accept these conditions and must agree with them. If you do not agree with these conditions then please do not use this website. If you have any queries or concerns then please contact us before making any order online.
Top Oil may at any time and without any notice to any user make changes to terms and conditions on this website.
Any personal details you add on this website will be held with the strictest confidence and will not be shared with any third party. We hold personal information to allow us to be able to contact you or to locate your address so the order can be completed with no issues or problems.
If there are any delivery requirements that will help with the efficiency of the order then you need to tell us in the comment box provided.
Please ensure all tanks or fill posts into which our delivery is being made is safe and is made to meet statutory requirements.
We are not responsible for any unforeseeable loss or damage that you suffer as a result of our negligence. We will be responsible for any negligence that you suffer that is our fault and was foreseeable. Our total liability to you whether in tort, contract, restitution, misrepresentation or otherwise for loss of profit, loss of commercial, loss of anticipated savings, indirect or consequential loss arising out of or in connection with the duties of our staff will be limited to 200% of the amount paid for the service and oil.
Nothing in these terms and conditions excludes our liability for death or personal injury caused directly by our negligence, fraud, or any other appropriate incident.
Communication with us may be by phone or email.
We are not responsible for any events outside our control which affect the service. We believe given these conditions the time period we are expected to carry out our services will be extended.
Any dispute or claim arising out of these terms and conditions will be governed by Northern Irish Law and will be subject to the courts of Northern Ireland's exclusive jurisdiction.
Delivery - Top Oil will deliver to the address put into the form on the website. Delivery of the goods will have taken place once the oil passes through the hose connection of the storage tank, container, receptacle, vessel or fill line which you have provided for receiving delivery.
You must pay for the goods prior to delivery.
CANCELLATION AND REFUND POLICY
if you place an order and want to cancel it you can do so provided that the delivery has not already started. If the delivery has not already started then we can refund any money paid by you via the worldpay system that is in operation less any fees that may be involved.
Ownership of the goods remains with us until payment has been received and until then we may receive or resell the goods or any part of them and our servants or agents may enter upon your premises to recover the fuel.
